Investors: Certificate Holders of Fannie or Freddie Securitization Trusts Guarantees the Loan: Federal National Mortgage Association (Fannie Mae)
Comments: Fannie Mae does not make loans. They guarantee them. They pool loans, creating securitization trusts, and sell "Certificates" (like a share of stock) to Investors. Fannie and Freddie guarantee Investors the original Principal and interest. In return, they are able to borrow "cheap" money from the Investor-world.
In this scenario, the owner of the debt, and custody of the Mortgage Loan files is NOT in the hands of Fannie Mae or Freddie Mac, but rather in the hands of the Trustee over the Trust where the mortgage files reside.
Fannie Mae and Freddie Mac were "bailed out" by taxpayers in 2008. However, access to the actual location of people's loans has remained unavailable. Millions of foreclosures have occurred in the name of the Servicer, like BAC Home Loans LP or Wells Fargo Bank, N.A., which actually has no interest in the underlying debt. The correct party who has standing to foreclose would be the Trustee of the Fannie or Freddie securitization pool. Without access to this information, it is difficult to prove.
Recommendation: Taxpayers should call FHFA (conservator over Fannie and Freddie)and their legislators to demand access to Fannie and Freddie loan pools. Without public knowledge of the location of the loans, it leaves the public vulnurable to the wrong practices of the Fannie and Freddie's closed Retained Attorney Network (RAN).
