What is a Pooling and Servicing Agreement (P.S.A.)?

NOTE: Not all mortgage loans are securitized.
1) Only PSA's for public placement securitizations can be identified*.
2) Re: Government Sponsored Entities (GSE) - Taxpayers now own Fannie and Freddie. GSE loans: location of your loan pool has not been made public. If your loan is owned by a trust created by Fannie and Freddie, please call FHFA the conservator and regulator of Fannie and Freddie AND your legislators to demand access.
Please check the Fannie and Freddie websites first to see if either entity owns your loan before requesting assistance to find your PSA. If you have a Fannie Mae loan, here are the governing documents.
3) Re: Private placement securitization trusts - The identities of these trusts are usually not available and there are no governing documents filed with the SEC. The only way to obtain governing documents is through discovery*.

METHOD #1 (Scroll down for Method #2 - Going directly to the SEC):
Quick Method: Ask a trusted resource. Often, looking for a P.S.A. is like finding a "needle in a haystack."
INEXPENSIVE METHOD (from Full Disclosure, LLC). Once you receive the P.S.A., email the P.S.A. link directly to the SEC at
certified@sec.gov requesting a CERTIFIED copy of your P.S.A. If you do not receive a confirmation email from the SEC within a day or two, we advise that you send a follow up email.

STEP 3: Send the SEC the Pooling and Servicing Agreement
After you receive your P.S.A. from Full Disclosure, LLC, email Certified@SEC.gov a request for a certified copy of your pooling and servicing agreement. Alternate emails if the other one malfunctions: Christina Sarahan sarahan@sec.gov and Larry Mills millsl@sec.gov
If you do not receive a confirmation email from the SEC within a day or two, we advise that you send a follow up email.

METHOD #2: Free
Send the above data points directly to Certified@SEC.gov and request a certified copy of the pooling and servicing agreement (PSA). Note: Expect over a 30 day delay if they have to find it.
